PUBLIC SAFETY RESOLUTION NO. 2026056 RE: RESOLUTION OF THE DUTCHESS COUNTY LEGISLATURE IN SUPPORT OF NEW YORK STATE SENATE BILL NO. 8837 AND ASSEMBLY BILL NO. 2535, AN ACT TO AMEND THE GENERAL MUNICIPAL LAW, IN RELATION TO OPTIONAL DISABILITY COVERAGE FOR COUNTY PROBATION OFFICERS. Legislators VALDÉS SMITH, ALEXANDER, ARNOFF, BRENDLI, DRAGO, KAUL, KEARNEY, LAWLER, REDL, RHODES and SHAH offer the following Resolution and move its adoption: WHEREAS, Senate Bill No. 8837 and Assembly Bill No. 2535 have been introduced in the New York State Legislature, seeking to allow any county to opt-in and include county probation officers on the list of county employees who are eligible to receive through the collective bargaining process disability coverage equal to their full salary in the event that they are injured in the performance of their duties; and WHEREAS, probation officers’ duties involve them in virtually all phases of the criminal justice process, including investigations, presentencing, criminal supervision, treatment and other preventative corrective services; and WHEREAS, often, probation is relied upon more frequently as a viable alternative to incarceration or detention and probation officers find themselves performing many of the functions performed by their counterparts in the police and corrections services; and WHEREAS, probation officers are exposed daily to the risks and dangers involved in managing a potentially violent criminal population and they are regularly exposed to significant amounts of stress and aggravation, not to mention the possibility of bodily injury that may result from the performance of their duties; and WHEREAS, under the current law, probation officers are not eligible to receive comparable disability coverage for injuries they sustain in the performance of their duties; and WHEREAS, the legislation would allow for probation officers to receive equal treatment by permitting county employers and employee representatives to negotiate for this benefit through the collective bargaining process at their option with all costs to be incurred by the employer and/or employee, as determined through collective bargaining; now, therefore, be it RESOLVED, that We, the Dutchess County Legislature do support Senate Bill No. 8837 and Assembly Bill No. 2535 and urge the New York State Senate, Assembly and the Governor of the State of New York to enact such legislation; and be it further RESOLVED, that the Clerk of the Dutchess County Legislature is hereby directed to send certified copies of this resolution to the Honorable Kathy Hochul, Governor of the State of New PUBLIC SAFETY York, to all Senate and Assembly members whose districts include any or all of Dutchess County, New York, and to Timothy A.
