RESOLUTION NO. 2026089
RESOLUTION OF THE DUTCHESS COUNTY LEGISLATURE
ESTABLISHING THE STANDING COMMITTEE ON ARTIFICIAL
INTELLIGENCE AND TECHNOLOGY OVERSIGHT
Legislators MUNN, VALDÉS SMITH, ALEXANDER, ARNOFF, BRENDLI, DRAGO,
KAUL, KEARNEY, LAWLER, REDL, RHODES, SHAH and WINSBY offer the following and
move its adoption:
WHEREAS, artificial intelligence (AI) and related technologies, including large language
models, generative AI systems, agentic AI systems, AI-embedded software tools, algorithmic
decision-making systems, predictive analytics platforms, robotic process automation, biometric
technologies, and surveillance technologies, are being rapidly adopted across government at every
level, including within Dutchess County government and its agencies, departments, and contracted
service providers; and
WHEREAS, the Dutchess County Legislature recognizes that it has a responsibility, as the
legislative, appropriating, and policy-determining body of the County, to understand, investigate,
and oversee the use of artificial intelligence and related technologies across all branches and
agencies of Dutchess County government, including but not limited to executive branch
departments, the offices of independently elected county officials, county-contracted vendors, and
any entity performing services on behalf of the County; and
WHEREAS, the rapid pace of development of artificial intelligence and related
technologies poses significant risks to data security, worker rights, constituent privacy, civil
liberties, and equitable treatment, and creates the potential for significant financial commitments
embedded in AI and technology contracts and procurement decisions, making it essential that the
Legislature have a dedicated standing body with the authority and expertise to conduct ongoing,
continuous oversight of the use of such technologies throughout county government; and
WHEREAS, the use of artificial intelligence and related technologies in government
operations — including algorithmic decision-making systems, predictive analytics platforms,
robotic process automation, biometric and surveillance technologies, agentic and autonomous AI
systems, generative AI tools, and AI embedded in vendor-provided software — raises fundamental
questions of transparency, accountability, worker protection, constituent privacy, civil rights,
environmental impact, and fiscal responsibility that fall squarely within the Legislature's policy-
determining role; and
WHEREAS, the Dutchess County Legislature recognizes that artificial intelligence,
predictive, and related technologies, when responsibly developed, procured, and deployed, have
the potential to enhance governmental efficiency, improve service delivery, and support public
safety, and that realizing these benefits for Dutchess County residents requires dedicated oversight,
robust safeguards, and meaningful accountability; and
GOVERNMENT SERVICES & ADMINISTRATION
WHEREAS, without dedicated legislative oversight, the adoption of artificial intelligence
and related technologies across county government may proceed without adequate public scrutiny,
legislative review, or consideration of the risks such technologies pose to county employees,
constituents, and the integrity of county operations; and
WHEREAS, Section 2.02(m) of the Dutchess County Charter expressly grants the County
Legislature the power to conduct studies and investigations in furtherance of its legislative
functions, and in connection therewith to obtain and employ professional and technical advice,
appoint citizens' committees, commissions and boards, subpoena witnesses, administer oaths, and
require the production of books, papers and other evidence necessary or material to such studies
or investigations; and
WHEREAS, Section 32.05 of the Dutchess County Administrative Code grants to the Chair
of any standing committee of the County Legislature the power to subpoena and compel the
attendance of witnesses and the production of books, records, and papers as the same may be
pertinent to the committee's functions; and
WHEREAS, Rule 5.1 of the Permanent Rules of the Dutchess County Legislature
authorizes the Legislature to create standing committees by resolution, provided the resolution
specifies the power, duties, and number of committee members; and
WHEREAS, Rule 5.2 of the Permanent Rules provides that every committee shall have
actual or implied authority to do whatever is necessary to carry out the functions of the committee
or whatever is reasonably incidental thereto, including the authorization of its Chair to act on the
Committee's behalf in administrative and investigative matters; and
WHEREAS, Rule 5.6 of the Permanent Rules authorizes any committee of the Legislature
to accept advice and counsel from citizens who are not members of the Legislature, enabling the
Committee to draw upon the expertise of technologists, labor representatives, privacy and civil
rights advocates, and other relevant specialists; and
WHEREAS, all meetings of the Standing Committee on Artificial Intelligence Oversight
will be open to the public, with minutes and recordings made publicly available, ensuring ongoing
transparency and public accountability; and
WHEREAS, the Dutchess County Legislature is committed to ensuring that any adoption
or use of artificial intelligence and related technologies within county government is transparent,
accountable, equitable, protective of workers and constituents, and subject to meaningful
legislative oversight; now, therefore, be it
RESOLVED, that the Dutchess County Legislature hereby establishes the Standing
Committee on Artificial Intelligence and Technology Oversight (hereinafter "the Committee") as
a standing committee of the Dutchess County Legislature, pursuant to Rule 5.1 of the Permanent
GOVERNMENT SERVICES & ADMINISTRATION
Rules of the Dutchess County Legislature and Section 2.02(m) of the Dutchess County Charter;
and be it further
RESOLVED, that the Committee shall be composed of seven (7) voting members of the
Dutchess County Legislature, appointed by the Chair of the Legislature in accordance with Rule
5.3 of the Permanent Rules within thirty (30) days of the adoption of this resolution or within thirty
(30) days of the Organizational Meeting in each subsequent year; the Chair of the Legislature,
Majority Leader, Assistant Majority Leader, Minority Leader, and Assistant Minority Leader shall
serve as ex officio members pursuant to Rule 5.3; and be it further
RESOLVED, that the Chair of the Standing Committee on Artificial Intelligence and
Technology Oversight shall receive no stipend for service in that capacity during the 2026 calendar
year; and be it further
RESOLVED, that the mandate of the Standing Committee on Artificial Intelligence and
Technology Oversight shall include the following powers and duties:
(a) Investigation and study: to conduct ongoing studies and investigations into the current
and proposed use of artificial intelligence technologies — including but not limited to large
language models, generative AI tools, agentic AI systems, predictive AI, and AI-embedded
software — across all branches of Dutchess County government, all executive branch
departments and agencies, the offices of all independently elected county officials, and all
vendors and contractors performing services on behalf of the County;
The Committee's investigative mandate shall extend to any automated, algorithmic,
predictive, or data-driven technology, including but not limited to algorithmic decision-
making systems, predictive analytics platforms, robotic process automation, biometric
technologies, and surveillance technologies, that performs functions previously performed
by humans, makes or materially influences decisions affecting county employees or
constituents, or involves the collection, processing, or sharing of personal data, regardless
of whether such technology is characterized by its vendor or developer as artificial
intelligence.
The Committee's jurisdiction is limited to Dutchess County government and does not
extend to towns, cities, or villages within the County. The Committee may, however, invite
local government officials to participate voluntarily in its hearings and investigations,
develop model AI and technology governance policies for local governments to adopt at
their own discretion, and review the AI and technology implications of any shared services
arrangements through which the County provides technology services to local
municipalities.
(b) Information requests: to formally request, in writing, the production of information,
records, contracts, procurement documents, impact assessments, and other materials from
any county department, agency, office, or official, or any vendor or contractor performing
GOVERNMENT SERVICES & ADMINISTRATION
services on behalf of the County, relevant to the Committee's investigative mandate; all
recipients of such written requests shall provide a substantive and complete response within
fifteen (15) calendar days of receipt; a response that is incomplete, evasive, or otherwise
fails to substantively address the request shall be treated as a non-response for purposes of
triggering the Chair's subpoena authority under subsection (e); where the Chair determines
in writing that the complexity or volume of a request genuinely warrants additional time,
the Chair may grant a single extension of up to fifteen (15) additional calendar days,
provided that no response deadline shall extend beyond thirty (30) calendar days from the
date of the original request without approval of the Committee by majority vote; written
information requests may be initiated by the Chair of the Committee on behalf of the
Committee without requiring a prior vote of the Committee members, provided that the
Chair shall inform the Committee members of any such request at the next scheduled
Committee meeting; nothing herein shall preclude the Committee from directing the Chair
by majority vote to issue a specific information request or to refrain from issuing a request;
(c) Handling of sensitive and protected information: in carrying out its investigative
mandate, the Committee shall handle all information and materials produced in response
to information requests or subpoenas in a manner consistent with applicable law, including
but not limited to the New York State Freedom of Information Law, the Personal Privacy
Protection Law, applicable attorney-client and executive privilege protections, and any
other federal or state law governing the confidentiality of government records; where a
county department, agency, office, official, vendor, or contractor asserts that responsive
materials are exempt from disclosure or otherwise legally protected, such assertion shall
be made in writing with specific identification of the legal basis for the claimed exemption
within the response deadline established in subsection (b); the Committee Chair, in
consultation with the Counsel to the Legislature, shall determine whether the claimed
exemption is valid and whether the materials may nonetheless be reviewed by the
Committee on a confidential basis; nothing in this resolution shall be construed to require
or authorize the Committee to compel the disclosure of information in violation of
applicable law, nor to waive any privilege or protection to which the County or any of its
officers or employees may be entitled;
(d) Hearings: to convene public hearings and receive testimony from county officials,
department heads, vendors, labor representatives, constituent advocates, and expert
witnesses regarding the use of AI in county government;
(e) Subpoena authority: in the event that any county department, agency, office, official,
vendor, or contractor fails to provide a substantive and complete response to a written
information request within the time provided, or refuses cooperation with the Committee's
investigative mandate, or provides a response that the Chair determines to be incomplete,
evasive, or otherwise inadequate, the Chair of the Committee may exercise the subpoena
authority granted by Section 32.05 of the Dutchess County Administrative Code to compel
GOVERNMENT SERVICES & ADMINISTRATION
the attendance of witnesses and the production of books, records, and papers pertinent to
the Committee's functions; the Chair of the Committee shall notify the Chair of the
Legislature and the full Legislature prior to the issuance of any subpoena;
(f) Recommendations: to develop and transmit to the full Dutchess County Legislature
written recommendations for resolutions, local laws, procurement policies, contract
standards, and other legislative actions governing the use of Al in county government; the
Committee itself shall have no independent authority to direct any county agency,
department, or official, and all binding policy directives shall require separate action by the
full Legislature;
(g) Procurement review: to review and advise on any proposed county contract or
procurement that includes, embeds, or relies upon artificial intelligence technologies, and
to recommend to the full Legislature whether such contracts or procurements require
legislative approval or modification; and
(h) Future policy development: to study and develop recommendations for a
comprehensive AI use policy for Dutchess County government, including standards for
transparency, data security, worker protection, constituent privacy, civil rights and equity,
environmental impact, and procurement, for consideration and adoption by the full
Legislature; and be it further
RESOLVED, that all meetings of the Committee shall be open to the public with minutes
and recordings made publicly available on the County Legislature's website except as otherwise
provided by law; and be it further
RESOLVED, that the Clerk of the Dutchess County Legislature is hereby directed to: (i)
transmit a certified copy of this resolution to the County Executive, the County Comptroller, the
County Attorney, the County Clerk, the Sheriff, the District Attorney, and the heads of all executive
branch departments, so that all branches and agencies of Dutchess County government are duly
notified of the establishment of this Committee, its mandate, and the expectation of their full and
timely cooperation; and (ii) calendar for the January Organizational Meeting of the County
Legislature an amendment to Rule 5.13 of the Permanent Rules adding the Standing Committee
on Artificial Intelligence and Technology Oversight as a named standing committee consistent
with this resolution.
