Resolution declaring our intent to engage with PERMA
New York State law allows counties to operate Self-Insured Workers' Compensation Plans and permit
municipalities to participate as members of the plan to pool risk, gain efficiency and benefit from cost savings
by avoiding purchasing commercial insurance.
Risk Management has been exploring an option with PERMA (Public Employer Risk Management Association)
which could potentially result in a more favorable structure yielding reduced per claim deductibles, improved
long-term reserve liability exposure and additional safety training support for all participants.
We have decided that it is in the best interest of the County to contract with PERMA effective January 1,
2027, for coverage and administration of our self-insured Workers Compensation plan. PERMA requires a
resolution by legislature indicating our intent to engage with them and has offered the sample below for
your consideration.
RESOLVED, That the Dutchess County Selfinsured Workers' Compensation Plan hereby elects,
pursuant to Subdivision 3 of Section 50 of the Workers' Compensation Law, to become a member of the Public
Group Self-Insurer Public Employer Risk Management Association (PERMA) to secure its Workers'
Compensation claims, and be it further
RESOLVED, That pursuant to 12 CRR-NY 317.13 of said Workers' Compensation Law, ' notice of such
election shall be filed forth with the Chair of the Workers' Compensation Board, Self Insurance section; and be
it further
RESOLVED, That this election shall become effective 1/1/2027.
