CONSENTING TO THE ISSUANCE BY THE DUTCHESS COUNTY
WATER AND WASTEWATER AUTHORITY OF ITS SERVICE

Legislators BRENDLI, CASWELL, HOUSE, LAWLER and REDL offer the following
and move its adoption:
WHEREAS, the County of Dutchess, New York (the "County"), for and on behalf of the
Dutchess County Water District, and the Dutchess County Water and Wastewater Authority (the
"Authority"), have entered into a Service Agreement, Amended and Twentieth Restatement as of
December 1, 2025, relating to an integrated water supply, purification and distribution system (the
"Service Agreement"), and
WHEREAS, the Authority proposes to issue notes and bonds not to exceed $1,250,000 (the
"Notes and Bonds") to finance construction of the West Dorsey Water System and interconnection
to the Town of Hyde Park Regional Water Distribution System to provide availability of a new
water supply source for approximately six developed properties that could replace the current
groundwater wells servicing each property, and one vacant property to avoid the drilling of a
groundwater well, and
WHEREAS, Section 5.2(a) of the Service Agreement requires the consent of the County
to the issuance of such Notes and Bonds, now, therefore, be it

Dutchess County Water and Wastewater Authority of its Notes and Bonds provided that the
aggregate principal amount of the Notes and Bonds does not exceed $1,250,000. The County of

Resolution Request
May 28, 2026
Please find attached a Resolution Request Form and Fiscal Impact Statement. The purpose of the
requested resolution is to obtain County consent to the issuance of West Dorsey Water System (County
Water District Zone of Assessment "028A" and "028B") Notes and Bonds in an aggregate amount not to
exceed $1,250,000. The purpose of the Notes and Bonds is to fund construction of the West Dorsey
Water System and interconnection to the Hyde Park Regional Water Distribution System. This will
provide a new water supply source for approximately six developed properties to replace the current
groundwater wells serving each property, and one vacant property to avoid the drilling of a
groundwater well. Of the six developed properties, three are public water supplies with deteriorated
water quality, while a fourth developed property is not operational due to the requirements of being a
public water supply and the inability to address the deteriorated water quality of its current
groundwater wells.
Debt service on the Notes and Bonds will become a component of the County Service Fee payable by the
County to the Authority pursuant to the Service Agreement by and between the County on behalf of the
County Water District and the Dutchess County Water and Wastewater Authority, Dated June 1, 1998,
Amended and Twentieth Restatement as of December 1, 2025. The County will generate the revenues
necessary to pay this component of the Service Fee by levying benefit assessments against all properties
within the County Water District Zones of Assessments "028A" and "028B".
Please find Resolution 2023223, which can be used as templates for the requested resolution.
