REPLACEMENT OF BRIDGE L-29 (BIN 3343270), CR 21 (NOXON RD) OVER THE
JACKSON CREEK
TOWN OF LAGRANGE, DUTCHESS COUNTY
The Engineering Division is in the process of completing the right-of-way acquisitions for the subject property.
Acquisitions are only needed from one owner. The owner of the property has rejected the offer. This office
would like to proceed to condemnation and offer the following opinion on the de minimis nature of the
acquisition.
The deeded property is a 246.7 parcel, separated into three lots by CR 21 and Rymph Road. We are seeking a
temporary easement of approximately 2,919 square feet (0.067 acres) for a temporary relocation of the
driveway and general construction purposes for the bridge replacement project. This acquisition impacts the
largest of the lots, which is approximately 200 acres, as measured in Dutchess County's Parcel Access online
tool. The temporary relocation of the driveway is necessary to provide adequate working area for the contractor,
as well as to provide adequate ingress and egress to the parcel during construction for the owner, visitors,
deliveries, and emergency vehicles.
The general construction purposes will include but not be limited to removal of vegetation, site access, and
earthwork. It includes the removal of a mature tree valued in the appraisal. The 0.067 acres that constitute the
easement area are approximately 0.027% of the total tax parcel, and 0.033% of the approximate 200-acre lot.
Additionally, the impacts of the easement are temporary in nature. The project is anticipated to take place over
a single construction season, taking 4-6 months to complete. The acquisition and related work will not have
significant impact on the surrounding environment, property value, or use of the property. Due to these factors,
it is my opinion that this acquisition is de minimis.
