("THC" or the "Applicant"), we respectfully submit this application for Site Plan Approval and Special Use Permit for a cannabis retail dispensary at 794 Dutchess Turnpike (Tax Map Parcel 6262-04-561004), located in the B-H (Highway Business) zoning district. A pre-application meeting was held with the Planning Department on June 8, 2026. THC holds an Adult-Use Retail Dispensary License issued by the New York State Office of Cannabis Management (License No. OCM-RETL-26-000506, effective May 20, 2026) authorizing in-person retail sales with delivery at this location. The property is owned by North Plank Development Co. L.L.C., which has authorized this application. Project Description. The proposed project involves the interior fit-out of the western portion of an existing commercial building (approximately 3,100 square feet) for use as a cannabis retail dispensary, together with exterior facade improvements. The eastern portion of the building will operate as an insurance office. The project scope includes interior renovations to create a sales floor, point-of-sale area, vault, office, break room, mantrap, and related support spaces; exterior cladding in wood slat, brick, and stone finishes; replacement exterior lighting; and new signage (a wall-mounted facade sign and a freestanding monument sign). No new construction or expansion of the building footprint is proposed. No site grading, excavation, or increase in impervious surface coverage is proposed. The existing parking lot (19 spaces, exceeding the 16 required) will be configured as proposed. The building's existing HVAC system will be reutilized with interior ductwork modifications to serve the new layout. Cannabis retail sales are a special use in the B-H district pursuant to §210-35 C.(4), subject to the requirements of §210-61 and the issuance of a Special Use Permit. Property card: https://gis.dutchessny.gov/parcelaccess/property- card/? parcelgrid=13468900626000045353130000&parcelid=79410 History Per the 2011 Reconnaissance-Level Historic Resource Survey Update, the house presently situated at 11 Vassar Road was constructed in 1850 for Benjamin Everett.' Having purchased the land from Le Grand Dodge in 1846, I am unsure as to the exact reason the house was originally constructed.? I suspect that the house was not constructed for habitation. In 1850, Benjamin Everett is listed as having lived just south of his new property, indicating he was already well-situated prior to this new construction. I suspect its initial purpose was as an inn or similar such business, but I cannot provide sufficient information to support this claim. Regardless, the property was sold by Everett to James A. Seward on April 24, 1859.4 The property was sold again by Seward to John Roach in 1862, who sold it to Adrian M. Cornell five years later. Cornell then sold the house back to Roach in 1868.6 There are two areas of note in regard to these sales. First, is that Adrian Cornell also did not live on the property, further indicating its primary use as a business rather than residential.? Second, is the involvement of John Roach. John Roach owned several properties in the Poughkeepsie area throughout his life, but his primary business was naval construction. He was contracted by the presidential administration of Chester A. Arthur to construct the first four steel warships for the U.S. navy in the 1880s, an endeavor which bankrupted his company and apparently contributed to his death soon thereafter. After his death the property found its way into the hands of William H. Howell, who leased the property to Raymond J. Gibson and William E. Gibson. After remodeling the original house, the Gibson brothers would open the property on August 17, 1937 as the ' https://www.townofpoughkeepsie.com/DocumentCenter/View/163/Survey-Report-PDF, page 111 2 See attached photographs 1A & 1B 3 See attached photograph 2A 4 See attached photograph 3A, 3B, & 3C 5 See attached photographs 4A, 4B, 4C, & 4D 6 See attached photographs 5A & 5B ' See attached photograph 6A :. 8 See attached photograph 7A & 7B Gibson's Colonial Inn, a staple of the area for the next few decades.? The inn would be sold to William P. Nejame on July 14, 1959, who maintained the inn until his retirement in 1977.'011 After his retirement, Gibson's Colonial Inn would close, becoming several different restaurants over the course of the late 1970's and 1980's. First it became the Country Bread Board, which became Agron's Restaurant in October 1981.'2 Agron's was run by a couple: Meani & Bukurjie Dika, who also acquired the property from either Howell or an interim owner.' By 1986 the property was sold by the couple to J. Crotone Properties Inc., who leased it to SCO-Pet Inc. as La Trattoria from 1986 to 1989.14 It was then leased to John R. Davis, Timothy D. Murphy, and Merrick Egan, who reopened the property as the Hobnobbin' Pub in 1989.'5 The pub would close in 2016, whereupon the property was purchased by Geraldon Realty Inc. under Bob Dooley, who reopened the property as The Gibson, in honor of the Gibson's Colonial Inn. 1617 After a few years, he then rebranded the establishment as the Poughkeepsie Steakhouse, which is how the property remains to this day. 9 See attached photograph 8A 10 See attached photograph 9A & 9B 11 https://www.townofpoughkeepsie.com/DocumentCenter/View/163/Survey-Report-PDF, page 111 12 See attached photograph 10A & 10B 13 See DutchessCountyClerkRecordingPage_JCrotoneProperties to GeraldonRealtylnc.pdf 14 See Certificate of Assumed Name- La Trattoria.pdf 15 See Memorandum of Lease - Crotonelnc to Davis & Murphy.pdf 16 See DutchessCountyClerkRecordingPage_JCrotoneProperties to GeraldonRealtyInc.pdf 17 https://www.poughkeepsiejournal.com/story/entertainment/dining/greattastes/2016/12/27/gibsons-restaurant-open-ties- 80-year-past/95870038/ IB: Dutchess County Deeds 1846-1847, vol 83-84 - Le Grand Dodge to Benjamin Everitt - October 28, 1846, p2 drine dien -р.л as matie 1 a date chin ching to be chai sit fil, mini begin Mike i elane? did. in Turn cinde all 1 di shot le and dere anto opene aid, pro te lidden stor in fio a parcel Healt it is tort in emine fun timis 10521 e/Dl0 Ce late. antony so shares 73e4 ching tact hat Is a blade fort there timeliest to Menny 90 sitin lon 3A: Dutchess County Deeds 1859, vol 113-114 - Benjamin H. Transportation is a leading source of emissions; this source accounted for nearly 40% of municipal emissions based on the Local Government Operations GHG emissions inventory and a similar percentage of community emissions in the Community GHG emissions inventory. Our town seeks to lead by example in sustainability while ensuring efficient delivery of public services. The Town commits to: 1. Lowering operating costs through efficient fleet management. 2. Using transparent, data-driven decision-making in fleet procurement and operations. 3. Reducing fuel consumption and GHG emissions. 4. Expanding the use of zero-emission and low-emission vehicles where feasible based on the above considerations. Fleet Inventory Baseline & Tracking • The Legislative Aide, in coordination with the Senior Mechanic, Comptroller's Office, Highway Superintendent, Water Superintendent, and Sewer Superintendent shall maintain a comprehensive fleet inventory of all municipal vehicles and equipment. • Updates: The inventory shall be updated annually and published annually as part of the town's capital budgeting process. • Data Collected per Vehicle: • Year, make, model, VIN • Drivetrain type, weight class, and EPA classification • Fuel or power source • Miles per gallon (or kWh/mile for EVs) • Annual miles driven and usage rate • Fuel/power consumption and cost per mile • Department and function Emission Reduction Goals The objective is to reduce emissions from approximately 1,120 MTCO2e to approximately 652 MTCO2e in 2030. To reduce gas-fueled vehicle emissions by 30%. To reduce diesel-fueled vehicle emissions by 10%. To replace 75% of gas-powered maintenance equipment with electric-powered maintenance equipment. All new purchases of maintenance equipment shall be electric unless otherwise waived by the relevant Department Head and Town Supervisor. • Short-Term Goal: Reduce total municipal fleet GHG emissions by 30% by 2030 compared to the 1990 levels. • Long-Term Goal: Transition to a 100% zero-emission light-duty fleet by 2050, with medium- and heavy-duty transitions as technology and funding allow. Procurement Policy General Rules • The Town shall purchase, lease, or otherwise acquire the most energy-efficient and cost-effective vehicles that meet operational needs. • Vehicles shall be right-sized — the smallest, most efficient vehicle that can effectively perform the intended function. Electric Vehicle Priority • Light-Duty Vehicles: All new purchases must be EV or Plug-in Hybrid (PHEV) unless a waiver is granted by the Town Board due to: 1. Lack of available models that meet functional needs, or 2. Excessive cost that cannot be offset through grants or incentives. • Medium & Heavy-Duty Vehicles: EV or low-emission alternatives shall be prioritized where cost and operational performance are comparable. Minimum Efficiency Standards • Passenger Cars: ≥18 MPG (gas/diesel) or ≥55 MPGe (electric/hybrid). • Light-Duty Trucks / Small Vans: ≥15 MIG (gas/diesel) or ≥50 MPGe (electric/hybrid) Medium-Duty Vehicles (Class 3-5): ≥15 MPG (gas/diesel) or ≥40 MPGe (electric/hybrid) • Heavy-Duty Vehicles (Class 6-8): 26 MPG (gas/diesel) • Minimum standard for the entire fleet: ≥16 MPG (gas/diesel) or ≥55 MPGe (electric/hybrid). Exemptions for emergency, specialty, and heavy-duty vehicles shall be documented and approved. • The town shall meet the minimum efficiency standard five years from the fleet policy's adoption. Fleet Rightsizing & Replacement • Rightsizing Review: Vehicles driven less than 5,000 miles/year or consuming under 200 gallons of fuel/year shall be evaluated for removal or reassignment. • Replacement Priority Order: 1. Zero-emission vehicles (EV) 2. Alternative-fuel vehicles (e.g., CNG, hydrogen, biodiesel) 3. Hybrid vehicles 4. Conventional high-efficiency gasoline vehicles 5. Conventional diesel (last resort) • Lifecycle Costing: Replacement decisions will consider total cost of ownership, including purchase price, fuel, maintenance, and residual value. Vehicle Reassignment/Sharing: Vehicles may be reassigned based on need determine y the Town Supervisor and vehicles sharing will be encouraged. Efficient route plannin is required by employees using vehicles. Operational Efficiency Measures • Anti-Idling: Limit idling to no more than 5 minutes, with exemptions for emergency operations or equipment power needs. • Maintenance: All vehicles shall be maintained to meet or exceed manufacturer-recommended service intervals. • Driver Training: Staff operating municipal vehicles shall receive training on fuel-efficient driving practices. Funding & Incentives • The Town will seek grants to offset the cost of EVs, charging infrastructure, and alternative-fuel technology. Reporting & Transparency • Annual Public Report: The Legislative Aide shall present a Green Fleet Report each year, including: • Current fleet inventory • Fuel consumption and costs • Emissions data • Progress toward goals • Planned replacements and infrastructure projects • This report will be made available to the public via the Town website. Review & Policy Updates • The policy shall be reviewed every five years to adjust efficiency standards, incorporate new technologies, and align with updated state and federal guidelines. The Area of Potential Effect for this Project is considered to be t1.4 acres of undisturbed land that will be impacted by the proposed project. The Phase 1A survey consistsof the background research for property. PHASE 1A LITERATURE SEARCH AND SENSITIVITY ASSESSMENT The Phase 1A Literature Search and Sensitivity Assessment will assess the overall sensitivity of the site based on environmental factors and whether portions of the site have been disturbed, assess the level of that disturbance and determine whether Precontact or historic sites have been identified in the vicinity of the project area. The Phase 1A will include a site visit to photograph the existing conditions which will include any existing structures within the project area. Research will be undertaken to determine former land use, and a review of the archaeological site files housed at New York State's Office of Parks, Recreation and Historic Preservation will be completed. Cartographic materials available at the Library of Congress or the New York State Archives will be reviewed to determine if any historic structures (Map Documented Structures) were located within the property boundaries. The final Phase 1A report will include the scope of the proposed undertaking (if known), a discussion of the environmental conditions on the property, a Precontact sensitivity assessment and an assessment of any historic properties with photo-documentation of the existing conditions. The Phase 1A will also evaluate any impacts to any adjacent National Register Propert(ies). HCS will work with the project sponsor to submit the report to OPRHP through their Cultural Resource Information System (CRIS). NYS OPRHP is currently recommending that all reports for Cultural Resource Surveys be submitted into their GIS based system (CRIS) by the consultant who completed the survey. All involved agencies for the project must be identified in the project submission in CRIS. The cost of this submission is included in this proposal. WORK SCHEDULE AND PROJECT TIMING A work schedule will be coordinated upon receipt of authorization to proceed. The reports can generally be completed within three (3) to four (4) weeks of authorization, dependent on the timing of the site visit. Poughkeepsie NY 12603 Cell: (914) 382-2260 Email: [email protected] : OWN OF POUGHKEEPSIE TOWN CLERK Date: 8/18/2026 Dear Town Clerk's Office, Members of the Town Board, and Superintendent Mir. Simon, We are writing to formally request an immediate traffic-safety evaluation of the intersection located in the Town of Poughkeepsie in the intersection of Marple Rd., Seitz Terr., and Ray Blvd., including consideration of installing an additional stop sign and/or other appropriate traffic-control measures. My family and I have lived at our home for approximately eight months, and during that relatively short period, we have already witnessed multiple accidents and dangerous incidents at this intersection. The frequency and severity of these incidents have become extremely concerning to us, to the point that we are afraid to spend time in the front of our home or in our garage because of the possibility that a vehicle could lose control and enter our property. Since moving here, we have personally witnessed two reported accidents, including the accident that occurred today. We have also witnessed several additional incidents during the winter months that were not formally reported, when vehicles lost control or slid down the hill because of snowy and icy road conditions. Additionally, our neighbors, many of whom have lived in the area for years, have told us that this intersection has been the site of numerous accidents throughout the years. This has made it clear to us that this is not an isolated or recent problem, but an ongoing safety issue that has affected the neighborhood for a considerable amount of time. On July 17th, a young girl riding an e-bike was struck by a vehicle at this intersection, leaving the young girl shaking and screaming in the middle of the intersection waiting for the ambulance to arrive. The vehicle was reportedly traveling at a high rate of speed, and the absence of a stop sign creates an environment in which drivers can proceed through the intersection without being required to stop. This incident was extremely alarming and demonstrated the very real danger this intersection presents. On August 23th, there was another accident involving two vehicles, with one of the vehicles ultimately crashing into the tree in front of my neighbor's home. Seeing another accident occur directly at this intersection, with both vehicles leaving the roadway and striking a residential property, has significantly increased our fear that a similar incident could happen to our own home. Our home is one of the corner homes directly situated at this intersection. Unlike my neighbor's property, there is no tree or other substantial barrier in front of our home. If a vehicle were to lose control in the same manner, there would be little to prevent it from traveling directly into our house. As a parent of a young baby, this is an especially frightening concern. We should not have to feel unsafe simply being in the front of our own home or in our garage because of the possibility of a vehicle crashing into our property. The situation becomes even more dangerous during the winter months. Because there is no stop sign requiring vehicles to slow down or stop, drivers often travel down the hill at high speeds. When snow and ice are present, vehicles can lose traction and slide down the hill. We have personally witnessed several such incidents since moving here. The combination of the steep hill, winter conditions, speeding vehicles, and the absence of a stop sign creates an extremely hazardous situation for residents, pedestrians, cyclists, and other motorists. At this point, these concerns are not hypothetical. Multiple accidents and dangerous incidents have occurred during the eight months that we have lived here, and our neighbors have confirmed that this intersection has experienced numerous accidents over the years. The fact that an accident occurred today, resulting in a vehicle striking a tree on my neighbor's property and the other one driving into the neighbor's driveway, is particularly concerning because it demonstrates how easily a vehicle can leave the roadway and reach a residential property. We are genuinely afraid that, without intervention, the next vehicle could enter our home, particularly because our property is directly at the corner and does not have a tree or other barrier between the roadway and our house. More importantly, we are concerned that someone could suffer a much more serious injury or even lose their life before appropriate safety measures are implemented I respectfully request that the appropriate department urgently evaluate this intersection and determine whether an additional stop sign, speed-control measure, traffic-calming device, or other safety improvement is warranted. Given the documented and witnessed history of accidents, as well as the concerns expressed by long-term residents, I strongly believe that preventative action should be taken before a more serious tragedy occurs. This request is being made out of genuine concern for the safety of our family and the entire neighborhood. We should be able to feel safe in our own home, garage, and community without fearing that a speeding or out-of-control vehicle could come through the intersection and strike our property. Thank you for taking this matter seriously and for your attention to this urgent safety concern. I respectfully request that this intersection be reviewed and that we be informed of any steps that can be taken to improve safety for everyone in the area. Respectfully, David and Karla Calle
